THIS SWEEPSTAKES IS OFFERED ONLY TO LEGAL RESIDENTS OF THE UNITED STATES (EXCLUDING WHERE PROHIBITED BY LAW) WHO ARE LOCATED IN THE UNITED STATES (EXCLUDING WHERE PROHIBITED BY LAW) AT TIME OF ENTRY.

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

HOW TO ENTER:

• Customers may register via Internet form as posted on www.BeADiver.com.  For return response by email, access to Internet and an active email account is required.
• “Sweepstakes Period”: Beginning at 12:01 am Pacific Time on January 23, 2012 and ending at 11:59:59 PM Pacific Time on December 31, 2012 customers can complete an Official Registration Form online, by logging onto www.BeADiver.com, and register by entering name, email, postal mailing address, gender (optional), phone (optional), age (optional), and by indicating from where they learned of the Be A Diver website.
• Customers must click on the “Submit” button to enter the Sweepstakes.
• “Weekly Deadline”: All entries must be submitted by 11:59:59 pm Pacific Time on the last day of the calendar week to be included in that week’s drawing.
• Must be 21 or older to enter Sweepstakes.
• Number of entries is limited to 1 per person per week.
• Limit one entry per person per week. In the event of a dispute regarding the identity of a person submitting an online entry, the entry will be deemed to be submitted by the person in whose name the email account is registered at time of entry.
• Sponsor and its agents are not responsible for undelivered, lost, late, misdirected, garbled, illegible, incomplete entries or for technical problems related to, or limiting the ability of an individual to participate in the Sweepstakes.
• If for any reason the online Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the online portion of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel or terminate the online Sweepstakes and select the weekly winner from all eligible entries received prior to the cancellation or termination.
• All entries become the Sponsor’s property and will not be returned.
• Those entering may receive email and postal correspondence from Sponsor or agents.

WINNER NOTIFICATION and ACKNOWLEGEMENT:

• Winners will be notified by e-mail, mail, or telephone.
• The contest winner may be publicized on the web site.
• Prize must be acknowledged within 7 business days of notification of winning the prize or the prize is forfeited.
• Prizes will be delivered to a current DEMA member retail store for pickup by winner. Allow up to 6 weeks for delivery to retail store for pick-up of prize.
• Any prize notification returned as undeliverable will result in disqualification and an alternate winner will be selected.

WEEKLY DRAWINGS:

• One winner will be selected for each week of the Sweepstakes Period in a random drawing that will take place approximately five business days after each weekly deadline from all eligible entries received. Odds of winning any weekly drawing depend on the number of eligible entries received by each weekly deadline.
• Drawings will be conducted by Sponsor or its designee, the judge of the Sweepstakes, whose decisions are final and binding on all matters relating to the Sweepstakes.
• Non-winning entries will not be entered into subsequent weekly drawings, but non-winning entrants may re-enter each week.

PRIZE (one per week):

• Three Be A Diver Trackable DiveCaching tags that can be logged online at www.Geocaching.com.
• Each winner is solely responsible for all taxes related to the prize.
• If any winner is a minor, the prize will be awarded in the minor’s name to his/her parent or legal guardian who must sign all required documents.
• Prize is non-transferable. No prize substitutions or cash redemptions allowed, except at Sponsor’s sole discretion. Each winner will have 30 days after notification to claim their prize in person at a store designated by the Sponsor.
• All unclaimed prizes are forfeited.

GENERAL:

Sweepstakes is governed by the laws of the State of California, with venue in San Diego County, California, and all claims must be resolved in the state or federal courts of San Diego County, California. By entering, entrants agree: (1) to be bound by these Official Rules, by the decisions of the judge, and by Sponsor’s Privacy Policy and Terms and Conditions; (2) to release and hold harmless Sponsor and its agents from any and all liability, injuries, loss or damage of any kind arising from their participation in the Sweepstakes and their acceptance and/or use/misuse of any prizes; and (3) to be contacted by Sponsor via e-mail. By accepting a prize, each winner consents to the use of his/her name and likeness for advertising, promotion and publicity purposes without additional compensation (except if winner is a resident of TN or where prohibited by law). All federal, state, and local laws and regulations apply.

ELIGIBILITY:

The Be A Diver website is open to legal residents of the United States (excluding where prohibited) who are 13 years of age or older at time of entry. The Be A Diver Weekly Giveaway is open to legal residents of the United States (excluding where prohibited) who are 21 years of age or older at time of entry. DEMA and its affiliates, subsidiaries, advertising and promotional agencies and their respective officers, directors, employees and agents (“Sponsor and its agents”) and the immediate family members and those living in the same household of each are not eligible.  Dive industry professionals and DEMA Members and their employees are not eligible.

WINNERS’ LIST:

For the names of the winners, send a self-addressed, stamped envelope to: DEMA, Weekly Giveaway, 3750 Convoy Street, Suite 310, San Diego, CA 92111, to be postmarked by December 31, 2011 and received by Sponsor by January 6, 2013.
